“[The] California legislature enacted very specific rules regarding spouses disclosing all of their information in a marital dissolution or legal separation action. Spouses must, by law, disclose all of their assets and debts in a dissolution or legal separation action, and the judge has discretion to decide the penalty when one spouse fails to disclose information.

Spouses have a fiduciary duty to always act in good faith and honesty toward one another. When spouses have control of the community property they must act in the best interests of the community or they are breaching their fiduciary duty.”
