“The Family Code defines several types of custody: (1) “Joint custody” means joint physical custody and joint legal custody. [Fam. Code, § 3002] Both parents have decision making authority and significant periods of physical custody. (2) “Joint legal custody” may be awarded to the parents without awarding joint physical custody. [Fam. Code, § 3085] Both parents share the right and responsibility to make decisions as to the child’s health, education, and welfare. [Fam. Code, § 3003] (3) “Joint physical custody” means that each parent has significant periods of physical custody, shared in a way that assures the child of frequent and continuing contact with both parents, subject to Fam. Code, § 3011 (factors that determine the child’s best interest) and Fam. Code, § 3020 (policy established by legislative findings and declarations). [Fam. Code, § 3004] (4) “Sole legal custody” means that one parent has the right and responsibility to make decisions as to the child’s health, education, and welfare. [Fam. Code, § 3006] (5) “Sole physical custody” means that the child resides with and under the supervision of one parent, subject to the court’s power to order visitation. [Fam. Code, § 3007]”
