“The Drug Dealer Liability Act (Health & Saf.C. § 11700 et seq.) gives to a wide range of persons directly or indirectly injured by illegal drug use the right to sue any person who “knowingly participates in the marketing” of the drugs. Potential plaintiffs include the drug user’s parent, guardian, child, spouse (or registered domestic partner, see Fam.C. § 297.5), sibling and employer, persons injured by the drug use, and, subject to certain limitations, the drug user. A defendant is generally liable for 25% to 100% of the damages, depending on the defendant’s volume of drug marketing. Liability must be shown by clear and convincing evidence.”
